EC: public consultations and call for data on various cosmetics ingredients

The European Commission is holding two public consultations and is calling for data on three ingredients used in cosmetics and personal care.

Tagetes, or marigold flower, is one such ingredient, with the Commission holding an ongoing public consultation (until 8 March) into its proposal to modify the relevant Cosmetics Regulation annex to restrict its use.

Similarly, the Commission is looking into Furfural - an organic compound derived from a variety of agricultural byproducts, including corncobs, oat, wheat bran, and sawdust, also used in cosmetics products (fragrances).  The consultation on the proposed amendment for Furfural will go on until 20 February 2017.

Lastly, the Commission is asking for safety data and relevant scientific information on the salts of O-Phenylphenol, a preservative, and is looking to hear from ‘any interested parties, including authorities of the Member States, manufacturers of cosmetic products, producers of the substances concerned and relevant industry and consumer associations’ by 15 February.

The proposal for the modification in the regulation around Tagetes use in cosmetics is as follows:

  • Restrict the use of Tagetes minuta and Tagetes patula extracts and essential oils at the concentration up to 0.01% in leave-on products (with the exception of sunscreens in which Tagetes minuta and Tagetes patula shall be banned), provided that alpha terthienyl (terthiophene) content of Tagetes minuta and Tagetes patula extracts does not exceed 0.35%.  

  • Allow for the use of Tagetes minuta and Tagetes patula extracts and essential oils in rinse-off products up to 0.1%, provided that alpha terthienyl (terthiophene) content of Tagetes minuta and Tagetes patula extracts does not exceed 0.35%.

Furfural - fragrance ingredient  

The proposal for the modification in the regulation around Furfural use is as follows:

  • Restrict the use of Furfural at the concentration up to 0.001% in cosmetic products.

Salts of o-Phenylphenol

The EC is inviting submissions for information on Salts of o-Phenylphenol by post or email, with details of the call available here.

“In order to prepare requests for scientific opinions to the SCCS, interested parties are invited to submit any relevant scientific information on the safety of Sodium o-Phenylphenate (CAS 132-27-4), Potassium o-Phenylphenate, (CAS 13707-65-8) and MEA o-Phenylphenate (CAS 84145-04-0) as preservative and non-preservative ingredients in cosmetic products and, in particular, data regarding all toxicological end-points and an indication on the suggested concentration safe limits for these ingredients,” the body states.
