eBay found guilty of counterfeiting in AdWords case

The Paris Tribunal de Grande Instance has ruled that by using LVMH’s brand names such as Kenzo and Givenchy as keywords to power its advertising via the Google platform, eBay is responsible for brand counterfeiting.

eBay was ordered to pay LVMH €80,000 in damages and a further €1,000 for each future infringement.

The ruling is in direct contrast to a Belgian court’s decision in a similar case regarding the Ralph Lauren brand.

Earlier this year a Brussels Court of Appeal ruled that using Ralph Lauren’s brand names in this way did not constitute a trademark infringement.
